After more than a year of implementation, Decree 40/2019/ND-CP amends and supplements a number of articles of the decrees detailing and guiding the implementation of the Law on Environmental Protection (hereinafter referred to as the Law on Environmental Protection). Decree No. 40/2019/ND-CP) issued on May 13, 2019 has made an important contribution to environmental protection, and at the same time overcomes shortcomings and inadequacies; drastically reform administrative procedures and cut many business investment conditions in the field of environmental protection.
In the context of the global Covid-19 pandemic, on the basis of the requests of businesses and industry associations, the Ministry of Natural Resources and Environment has reported to the Prime Minister to propose directions. solve and remove difficulties for production and business enterprises.
Based on the discussion of the Government members and the conclusion of the Prime Minister at the regular meeting of the Government in August 2020, held on September 4, 2020, solutions to solve and remove difficulties for production and business activities of enterprises in environmental protection is specified in Resolution No. 14, Resolution No. 129/NQ-CP dated September 11, 2020 Regular Government Meeting August 2020. As follows:
1. It is permissible to extend the time for completing the installation of automatic and continuous wastewater and gas emission monitoring systems specified in Clauses 20 and 23, Article 3 of Decree No. 40/2019/ND-CP to the end of 31/03. December 2021 (instead of December 31, 2020).
2. Allow extension until the end of December 31, 2021 for hazardous waste treatment permits (granted to enterprises by the Ministry of Natural Resources and Environment) in the cases specified in Clause 39, Article 3 of Decree No. 40/2019/ND-CP, and at the same time do not have to repeat the approved environmental impact assessment (EIA) report if the location is not changed, the capacity is increased as prescribed in Article 20 of the Law on Protection environment 2014.
3. Allow extension until the end of December 31, 2021 for the Certificate of eligibility for environmental protection in the import of scrap for use as raw production materials in the cases specified in Clause 39, Article 3 of Decree No. 40. /2019/ND-CP, and at the same time do not have to repeat the approved EIA if the location is not changed or the capacity is increased according to the provisions of Article 20 of the Law on Environmental Protection 2014.
Resolution No. 14, Resolution No. 129/NQ-CP assigns the Ministry of Natural Resources and Environment to be responsible for strictly and proactively implementing information and guidance on publicity and transparency on mass media. them for businesses and do not create additional administrative procedures in the implementation process. At the same time, continue to review and detect inadequacies and shortcomings in the implementation of Decree No. 40/2019/ND-CP, proposing the Government to amend and supplement in the direction of creating favorable conditions for businesses while still ensuring ensure state management requirements, combat negativity and corruption; prevent and combat environmental pollution, without affecting people’s lives.
This regulation is the basis for businesses to be assured of stability for production and business to quickly recover and stabilize the finances of businesses, as well as the country’s economy in general.
