On May 24, the Government issued Decree No. 55/2021/ND-CP amending and supplementing a number of articles of Decree No. 155/2016/ND-CP dated November 18, 2016 providing for penalties. administrative violations in the field of environmental protection.
According to the content of Decree No. 55/2021/ND-CP supplementing the provisions on “Applicable subjects” in Article 2 of Decree No. 155/2016/ND-CP, organizations sanctioned for administrative violations in the field of Environmental protection areas under this Decree include:
a) Private enterprises, joint stock companies, limited liability companies, partnerships and their dependent units (branches, representative offices) established in accordance with the Law on Enterprises ;
b) Cooperatives and unions of cooperatives established in accordance with the Law on Cooperatives;
c) Foreign investors, foreign-invested economic organizations, representative offices and branches of foreign traders in Vietnam, representative offices of foreign trade promotion organizations in Vietnam; Nam was established in accordance with the Law on Investment;
d) A state agency commits an act of violation that is not within its assigned state management task;
đ) Socio-political organizations, socio-professional organizations;
e) Public non-business units;
g) Other organizations as prescribed by law.
Decree No. 55/2021/ND-CP has also amended and supplemented violations of regulations on implementation of environmental protection plans; implement the decision approving the environmental impact assessment report; carry out the Certificate of completion of environmental protection works; protecting the environment in production, business, service activities or implementing construction projects, production, business and service plans without an environmental protection plan or an environmental impact assessment report. school; carry out environmental monitoring and supervision; violating regulations on discharging wastewater containing hazardous environmental information into the environment or discharging wastewater containing microbial parameters (Salmonclla, Shigella, Vibrio cholerae) according to national technical regulations on wastewater medical or discharge wastewater with pH outside the technical regulation threshold; environmental protection related to hazardous waste treatment activities and implementation of hazardous waste treatment permits; violating regulations on prevention, response and remedy of environmental incidents and environmental protection for chemicals, pesticides and veterinary drugs.
The contents specified in other provisions of Decree No. 155/2016/ND-CP are also replaced, amended and supplemented in detail in Decree No. 55/2021/ND-CP.
Decree No. 55/2021/ND-CP takes effect from July 10, 2021.
